Wild Creek Graphics® is an independent Australian creative, documentary and publishing studio. Our audiovisual, photographic, written, illustrated and recorded works are created through our own fieldwork, production, research and professional relationships.

Copyright in Wild Creek material is owned or controlled by Wild Creek Graphics® unless expressly stated otherwise.

No licence, permission or consent is granted for the reproduction, republication, distribution, broadcast, extraction, adaptation, commercial exploitation or other use of Wild Creek material except where expressly authorised by Wild Creek Graphics® in writing or otherwise permitted by law.

Credit, attribution, tagging, linking to Wild Creek or identifying Wild Creek as the source does not constitute permission or a licence.

MEDIA, PUBLISHERS AND THIRD-PARTY PLATFORMS

Wild Creek does not require or seek unauthorised republication of its work for exposure, audience growth, publicity or additional views.

Our films, photography, interviews and written works are produced for publication through channels and platforms selected and controlled by Wild Creek.

Media organisations, publishers, agencies, broadcasters, social media pages, content aggregators, advocacy groups, commercial organisations and other third parties must not assume that republication provides a benefit to Wild Creek or that claimed exposure creates an entitlement to use our material.

Wild Creek maintains its own established audience and distribution channels. The decision as to where, how and in what context our work is published remains with Wild Creek.

Statements such as “credit will be provided”, “we are helping promote the story”, “this will give you exposure”, “the material is already publicly available” or similar representations do not constitute authorisation.

PAID AUTHORISED USE

Any third-party use approved by Wild Creek will be subject to a commercial licence or agreed usage fee unless Wild Creek expressly determines otherwise in writing.

Approval will be considered only after Wild Creek has been provided with sufficient information regarding:

• the material requested

• the organisation requesting its use

• the publication or platform

• the intended context

• the duration and territory of use

• whether the use is commercial, editorial, broadcast, digital or promotional

Approval is not effective until the scope of use, applicable fee and any conditions have been agreed in writing.

Payment for a licence does not transfer copyright or ownership of the underlying work.

MEDIA AND PUBLISHER NOTICE

Wild Creek does not grant implied permission to journalists, editors, producers, researchers, publishers, broadcasters, documentary producers, digital platforms or media organisations.

Material requiring consideration before third-party use includes, without limitation:

• screenshots or still frames taken from Wild Creek films

• photographs and thumbnails

• video or audio excerpts

• interview recordings

• transcripts

• substantial extracts from written works

• original illustrations or graphics

• cropped, altered or reformatted Wild Creek material

• compilations incorporating Wild Creek material

• reproductions of material taken from Wild Creek websites, social platforms or published films

The fact that material can be viewed publicly does not place that material in the public domain or surrender Wild Creek's copyright.

STATUTORY RIGHTS AND EXCEPTIONS

Nothing in this policy is intended to exclude a use expressly permitted under applicable law.

However, a party relying upon a statutory exception or other legal entitlement is responsible for ensuring that the particular use genuinely satisfies the requirements of that law.

Attribution alone does not establish that a use is lawful.

Wild Creek reserves the right to challenge any claimed exception where the nature, quantity, purpose or context of the material used does not satisfy the applicable legal requirements.

TRADE MARK AND BRAND USE

WILD CREEK® and associated Wild Creek branding, logos and identifying marks must not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, partnership, approval or association with Wild Creek.

Wild Creek material must not be presented, edited, captioned, repackaged or placed within a publication, channel, campaign or commercial context in a manner that misrepresents Wild Creek, its work or its position.

This is particularly important where Wild Creek material or branding is associated with organisations, campaigns, causes, commentary or commercial activities with which Wild Creek has not agreed to be associated.

Where unauthorised use of Wild Creek branding or material causes or is likely to cause confusion, misrepresentation, reputational harm or commercial damage, Wild Creek reserves its rights to pursue remedies available under trade mark law, copyright law, passing off, the Australian Consumer Law or other applicable law.

Wild Creek will not accept the unauthorised placement of its identity or creative work into a third-party context simply because the underlying material has previously been published by Wild Creek.

CONTEXTUAL AND REPUTATIONAL INTEGRITY

Context matters.

Wild Creek exercises control over the manner in which its documentaries, interviews, photographs and other works are presented because publication alongside unrelated commentary, advertising, advocacy, sensationalised material or conflicting editorial positions may create a false impression regarding Wild Creek's involvement, endorsement or views.

Unauthorised editing, selective extraction, misleading captioning, false attribution or use that materially misrepresents Wild Creek or its work may be treated as a serious infringement of our rights.

Where such conduct results in demonstrable reputational or commercial damage, Wild Creek may pursue available remedies, including damages and recoverable enforcement or legal costs where legally available.

PERMIT PROTECTED MATERIAL

Some Wild Creek material is captured or produced under State or Commonwealth permits, approvals, licences or access authorities.

These arrangements may impose additional conditions governing access, filming, publication, locations, protected areas, wildlife, cultural material or the circumstances in which material was produced.

Third-party republication may interfere with Wild Creek's obligations or the controlled context in which the material was authorised or obtained.

Wild Creek therefore reserves the right to notify or refer unauthorised use involving permit-controlled material to the relevant land manager, government agency, authority, rights holder or other interested party where appropriate.

A third party must not represent possession of Wild Creek footage as providing that party with any permit, authority, access right or governmental approval held by Wild Creek.

OUR POSITION

Wild Creek invests substantial time, travel, equipment, production resources, research, access and professional relationships into the creation of its works.

Our material is not stock media.

Our material is not an unrestricted media resource.

Our material is not made available for third parties to build articles, channels, broadcasts, social posts or commercial publications around without appropriate authority.

Publication by Wild Creek does not constitute an invitation for republication by others.

Wild Creek determines where its original work is distributed and the commercial terms upon which authorised third-party use may occur.

ENFORCEMENT

Wild Creek actively monitors the use of its copyright material and branding across digital, social, broadcast and print platforms.

Where unauthorised use is identified, action may include:

• formal infringement notices

• platform copyright complaints and takedown procedures

• demands for removal or cessation of use

• claims for reasonable licensing or usage fees where legally available

• demands for correction of misleading attribution or representation

• preservation of evidence relating to publication, traffic and commercial use

• referral to legal representatives

• notification of relevant permit authorities or rights holders where appropriate

• commencement of legal proceedings where warranted

Wild Creek reserves all rights to seek damages, injunctions, accounts of profits, declarations, costs or other remedies available at law according to the circumstances of the infringement.

LEGAL REPRESENTATION

Wild Creek Graphics® engages specialist intellectual property and copyright legal services where required.

Significant, repeated or commercially damaging unauthorised use may be referred directly for legal assessment and enforcement.

Nothing in this policy limits any rights or remedies available to Wild Creek Graphics®.

LICENSING ENQUIRIES

Requests for authorised use must be submitted to Wild Creek Graphics® before the proposed publication or use occurs.

Approved use will ordinarily be subject to a commercial licensing fee and written conditions specifying the permitted scope of use.

Submission of a request does not constitute approval.

No use is authorised until written permission has been issued by Wild Creek Graphics®.
